
Family Violence Intervention Order
‘Family violence’ is defined in the Family Violence Protection Act as behaviour by a
person towards a family member that is physically or sexually abusive, emotionally
or psychologically abusive, economically abusive, threatening, coercive, controlling,
dominating or inducing of fear. Exposing a child to these behaviours also constitutes
family violence.
What is FVIO?
A Family Violence Intervention Order (FVIO) is a legal order issued by a court to protect individuals from family violence. It sets conditions that the respondent (the person against who an order is made) must follow to ensure the safety of the affected family members.
FVIO is civil in nature however breach of any condition of an interim or final order is a criminal offence.
Who Can Apply for an FVIO
An FVIO can be applied for by:

Someone on their behalf, such as a police officer or guardian

A parent, guardian, or carer for a child affected by family violence
The application can be made in the Magistrates’ Court or initiated by Victoria Police in urgent situations to ensure swift protection.
